Rejection of Plaint -- Permanent Injunction -- Suit Land Sold and Converted to Residential Use
When suit land had already been sold to the defendant and converted into residential land, and patta was issued to various persons, the plaintiff could not maintain a suit for permanent injunction without first seeking a declaration of Khatedar rights -- Since no such declaration was sought, the plaintiff had no legal right to file the suit -- Suit dismissed for want of cause of action--CPC, 1908 -- Order 7 Rule 11.
